Your Data – Your Rights

Under data protection legislation, you have statutory rights relating to your own personal data:

  • Access – you have the right to know what data we hold relating to you and why, and to receive a copy of it;
  • Rectification – you have the right to have inaccurate information about you corrected;
  • Objection – you have the right to object to the Service using your information, and we would have to stop unless we have a sound overriding reason to continue;
  • Erasure, restriction and portability – in specific circumstances, you have the right to have your personal data deleted, to put limits on what the Service may do with it or to receive a copy in machine-readable form to take to another organisation;

What happens next?

To progress your request the Service will require confirmation of your identity. You will need to provide

Personal Identity: Photographic proof of ID (passport or drivers licence)

Address Verification: Confirmation of your address (utility bill, council tax bill)

In both cases a scanned copy or an emailed photograph will be accepted with your request but you must ensure that both documents are signed and include the following certification wording:

“I certify that this is a true copy of the original document”

Is there a charge?

In most cases the Service will not charge a fee. However, where the request is manifestly unfounded, excessive or duplicated we may charge a “reasonable fee” for the administrative costs of complying with the request. If the Service do intend to charge a fee, we will notify you.

How long will it take?

Article 12(3) of the General Data Protection Regulation stipulates that information must be provided to you within one calendar month of your request unless the complexity i.e. the volume of data to be reviewed is large and then this may be extended by a further two calendar months. The Service will notify you if the response timeframe is likely to exceed one calendar month.
